SALES TERMS AND CONDITIONS OF SALE

These conditions of sale (from now on "Conditions of Sale") regulate the sale and offer of goods on this website www.it.barberpisterzi.com (from now on the "E-Site").

The goods purchased on the E-Site (from now on the "Products") are shipped directly from

PLAST PACK PACKAGING S.R.L. VIA PETROSA, 22 - 50019 SESTO FIORENTINO (FI), with the authorization of (from now on the "Seller"), NEWLIFE 30 SRLwith legal address at Via Felice Casati, 20 – 20124 Milano - P.Iva e C.F.: 03899140135.

The Seller uses SHOPIFY INC e-commerce software to sell its Products.

Before placing an order, it is necessary to read and accept these Conditions of Sale. Failing to accept the General Conditions of Sale makes it impossible to make purchases on the E-Site.

 

1.INTRODUCTION

 

1.1. The Conditions of Sale exclusively regulate the offer, forwarding, and acceptance of purchase orders for the Products on the E-Site between the Seller and the E-Site Customer/Users. 

 

1.2. Through the E-Site, the Seller offers the Products for sale and carries out its e-commerce activity exclusively towards its end users and "consumers," i.e., natural persons who act for intendments not related to commercial activity, entrepreneurial, artisanal, or professional, possibly carried out (from now on "Customer"). 

 

1.3. The sale of the Products refers exclusively to the countries indicated in the following list of shipping countries:

1.4. The Seller, however, reserves the right not to process orders from subjects other than the "consumer" and minors, from countries not included among those indicated in the shipping countries and territories or, in any case, to orders that do not adhere with its commercial policy. 

 

1.5. The General Conditions of Sale do not regulate the sale of goods or the provision of services by parties other than the Seller, even if they are present on the E-Site via banners, links, or other forms of connection. The Customer's responsibility is to check the conditions of sale before placing orders and purchasing services and goods from parties other than the Seller. Therefore, the latter is not responsible for the sale of goods and/or the provision of services by third parties and/or the conclusion of agreements between the Customer and third parties. 

 

2.PURCHASE ORDER OF PRODUCTS

 

2.1. To buy one or more Products on the E-Site, the Customer must select the Products he intends to buy and add them to the shopping cart. Once the choice of the Products has been concluded, the Customer must continue with the checkout at the shopping cart E-Site web page, fill in the order form in electronic format, according to the relative instructions, and send it to the Seller. 

 

2.2. The languages ​​available for the conclusion of the purchase are Italian and English. 

 

2.3. Order purchases of the Products can be made by the Customer both through their account, if registered on the website (E-SITE), and through the "guest" option. In this case, the Customer shall provide the personal information required to proceed with the evasion of the Order. 

 

2.4. The order form contains a reference to the Conditions of Sale and a summary of the information on the main attributes of each Product ordered, as well the related price (including all applicable duties and taxes), the means of payment accepted, and the methods of delivery of the purchased Products, of the shipping and delivery costs, of the conditions for exercising the right of withdrawal and of the methods and times for returning the purchased Products. 

 

2.5. Before proceeding with the purchase of the Products by sending the order form, the Customer must carefully read the Conditions of Sale, which may also print, store or make a copy for personal use. Once the order form is sent, the Customer declares to have approved and understood the content of the form itself and accepted the Conditions of Sale and Use of the E-Site while, failing that, it will not be possible to proceed with the Order purchase.

 

2.6. Before sending the purchase order form, the Customer will be able to check the specifics of the Order, as well as identify and correct any data entry errors. 

 

2.7. The forwarding of the order form by the Customer implies for the latter the accountability to pay the price indicated in the Order. 

 

2.8. Once the purchase order has been accepted, the Seller will send the Customer, by email, a receipt of the purchase order, which will contain the information relating to the essential characteristics of the Products and the detailed indication of the price (including all applicable taxes or duties), the means of payment, the conditions and methods of exercising the right of withdrawal and delivery costs. 

 

2.9. The Seller reserves the right not to accept purchase orders that are incomplete or incorrect, that do not give sufficient guarantees of solvency, or in the event of unavailability of the Products. In these cases, the Seller will inform the Customer within 14 days since the Order was sent by the Customer via email that the contract is not concluded and that the Seller has not carried out the purchase order. If the Customer has already forwarded the order form and paid the price, the Seller will refund the amount paid. 

 

2.10. The order form will be filed in the Seller's database for the period nedeed to progress the orders, and in any case, with respect of the terms of the law. If registered on the Site, the Customer will view the orders placed by accessing their account and consulting the appropriate section of the Site. The Customer who purchased a "guest" can check the orders placed by contacting Customer Service as indicated in paragraph "Customer Service" below. 

 

3. CHARACTERISTICS OF THE PRODUCTS

 

3.1. Only original products marked with the PISTERZI - ITALIAN GROOMING ART, TONSTRINA, and BARBER PISTERZI are offered for sale on the E-Site with the authorization of NEWLIFE 30 Srl.

 

3.2. The fundamental characteristics of the Products are shown on the E-Site within each Product page. The colors and images of the Products listed and displayed for sale may not coincide to the real ones due to the monitor used and/or Internet browser. 

 

4. PAYMENTS

 

4.1. Prices of the Products indicated on the E-Site are in EURO. They already include all applicable taxes and fees. The Products' prices do not include the shipping and delivery costs, which will be indicated on the final Site page of the checkout before purchasing the Products. 

 

4.2. The prices of the Products might be subject to changes. The Customer, consequently, undertakes to check the final sale price before sending the related order form. 

 

4.3. The payment methods can be found on the Site footer page, indicated in the single purchase order form, and are an integral part of the Conditions of Sale. 

 

4.4. The total purchase price of the Products and the shipping costs will be charged by the Seller at the time of the payment.

 

4.5. If the Customer chooses to pay by credit card, the financial information (the credit card/debit card number's or the date of its expiry) will be forwarded, via encrypted protocol, to banks or companies that provide the relative remote electronic payment services, without third parties having access to them in any way. The Seller will never use this information except to finalize the procedures relating to the purchase for which they are given and to issue the related refunds in the event of any returns of the Products, following the exercise of the right of withdrawal, or if it is necessary to prevent or report to the police the commission of fraud on the Site.

 

4.6. When the Product is delivered to a country belonging to the European Union, the Product sold shall not be subject to any customs clearance costs, such as import taxes and/or duties. 

In the case of delivery in a country not belonging to the European Union and other than the Products sold might be subject to customs clearance costs, such as duties, import taxes, and/or payable upon the arrival of the Products in the country of delivery. The prices of customs clearance cannot be foreseen in advance by the Seller and are, in any case, paid by the Customer.

For more information, the Customer shall contact the customs office of the country of delivery of the Product.

 

5. DELIVERY OF PRODUCTS

 

5.1. The delivery of the Products ordered on the E-Site takes place by express courier. The costs, methods, and terms of delivery of the Products are indicated on the "Shipping" page and in the single purchase order form and are an integral part of the Conditions of Sale. 

 

5.2. The delivery times of the Products indicated on the E-Site refer exclusively to working days, with the express exclusion of holidays. 

 

5.3. The Customer must place the purchase order directly from the E-Site page relating to the shipping country where the purchased Product will be delivered. The E-Site should recognize the country from which the Customer is connecting automatically, but it is possible to change the country of reference of the E-Site through the list of shipping countries on the E-Site's relevant page. 

Orders placed from a section of the E-Site relating to a country other than that of destination or an address not accepted by the courier appointed by the Seller (for example, P.O.Boxes and Fermo Posta) will not be accepted. 

 

6.RIGHT OF WITHDRAWAL

 

6.1. Customers have the right to withdraw from the contract concluded with the Seller, free of charge and without any giving reason, within 14 days from the day of physical possession of the Products purchased on the E-Site. 

 

6.2. To process the right of withdrawal, the Customer can communicate his decision to withdraw from the contract by emailing our customer service at: concierge.service@barberpisterzi.com

 

6.3. Alternatively, the Customer can send written and explicit communication of the decision to withdraw to the Seller, providing his personal details (name, surname, address, email), the order and receipt dates of the related Products purchased, and the order number. If the Customer chooses this option, the withdrawal notice must be sent to the Seller via email at:

6.4. In case of exercising the right of withdrawal, it is not possible to directly replace the chosen Product with another; to purchase a new Product, the Customer must place a new order distinct from the previous one. 

 

6.5. Only the Customer is responsible for the decrease in the value of the Products resulting from the manipulation of the Products other than that necessary to establish the nature, characteristics, and functioning of the Products themselves. 

 

6.6. The Seller reserves the right not to proceed with the withdrawal procedure if the Products are returned without the identification tag. 

 

6.7. The right of withdrawal cannot also be exercised if: 

 

  • the Products have been tailor-made or personalized;
  • the unsealed Products that have been opened after delivery do not lend themselves to being returned for reasons related to health protection and hygiene;
  • the Products are liable to deteriorate or expire rapidly;
  • The Products are, after delivery, inseparably mixed with other goods;

 

Return times and methods

 

6.8. The Products subject to withdrawal must be returned to the Seller. To proceed with the return, the Customer must return the returned Products, within 14 days from the date on which the Customer sent the relevant withdrawal form to the Seller, to:

6.9. The return shipment of the Products is charged to the Customer. 

 

6.10. It is advisable, where possible, to return the Products inside the package sent by the Seller. 

 

Refund times and methods

6.11. Upon receipt of the Products, the Seller shall make the necessary checks relating to their compliance with the terms and conditions indicated in this art. 6. 

 

6.12. If the checks are concluded positively, the Seller will send the Customer, via email, the relative confirmation of acceptance of the Products returned, and all payments refunds received from the Customer. 

 

6.13. Whatever payment method is used by the Customer, the refund is activated by the Seller after verifying the correct execution of the right of withdrawal, in the shortest possible time and in any case only within 14 days from the date on which the Seller received the request of withdrawal. The Seller may suspend the refund payment until receipt of the Products or until the Customer gives the evidence that he has returned the Products, whichever is earlier. 

 

6.14. The Seller will proceed with the refund using the same payment method used for the initial purchase by the Customer unless the latter has expressly agreed otherwise. If there is no correlation between the recipient of the Products indicated in the order form and someone else who made the payment of the sums due for their purchase, the reimbursement of the sums will be made by the Seller, unless otherwise agreed, to the person who made the payment. 

 

6.15. If the methods and terms for exercising the right of withdrawal are not respected, as specified in this art. 6, the Customer will not be entitled to a refund of the sums already paid to the Seller. The Customer might, at his own expense, get back the Products in the state in which they were returned to the Seller. 

 

7. LEGAL GUARANTEE OF CONFORMITY

 

7.1. In addition to the guarantee for defects in the goods sold, the Seller provides the legal guarantee of conformity on the products under the provisions of Title III of Part IV of Legislative Decree 6 September 2005 n. 206 (so-called Consumer Code). This guarantee provides that the Seller is responsible for any lack of conformity on the products sold that occur within 2 (two) years from the delivery of the products. 

 

7.2. Unless proven otherwise, it is assumed that the lack of conformity that occurs within 6 (six) months from the delivery of the Product already existed on that date, unless this assumption is not compatible with the nature of the goods or with the absence of conformity.  

 

7.3. To submit a request or take advantage of the guarantee of conformity, the consumer must report any defect in the Product purchased to the Seller within 2 (two) months of its discovery under penalty of forfeiture. The direct action to claim a lack of conformity not intentionally covered by the Seller, in any case, must be addressed within 24 (twenty-four) months from the delivery date of the Product. 

 

7.4. In the event of an absence of conformity reported within the established terms, the consumer can ask the Seller, at his choice, to replace the good or repair it, in both cases without any expense, unless the requested remedy is objectively impossible or excessively onerous compared to the other. The consumer can also ask, at his choice, an appropriate discount in the price or the cessation of the contract in cases where the replacement and repair are impossible or excessively expensive if the Seller has not replaced or repaired the goods within a reasonable time. 

 

7.5. To take advantage of the guarantee of conformity, keeping and showing the product purchase documents is, in some cases, recommended. For more details on the legal guarantee of conformity for consumers and taking advantage of the remedies provided for the legal guarantee concerning the products purchased from the Seller, the consumer can contact Customer Service via email at: concierge.service@barberpisterzi.com

 

8. PRIVACY

8.1. In regards to processing the Customer's personal data, please refer to our privacy policy

 

9. APPLICABLE LAW AND DISPUTE RESOLUTION

 

9.1. The General Conditions of Sale are governed by Italian law and in particular by the provisions of the legislative decree 6 September 2005 n. 206, containing the "Consumer Code", with reference to the provisions on distance contracts and the legislative decree 9 April 2003 n. 70 on certain aspects concerning electronic commerce. 

 

9.2. In the event of disputes between the Seller and each Customer, arising from the General Conditions of Sale, the Customer will be able to access the platform for online dispute resolution provided by the European Commission through the link https://webgate.ec.europa.eu/odr . 

 

10. MODIFICATION OF THE CONDITIONS OF SALE

 

10.1. The Conditions of Sale may be modified by the Seller at any time, considering any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on the E-Site. Customers are consequently invited to regularly access the Site and consult, before making any purchase, the most updated version of the General Conditions of Sale. 

 

10.2. The General Conditions of Sale applicable to each contract concluded by the Customer through the Site are those in force on the date the purchase order is sent. 

 

11. CUSTOMER ASSISTANCE

 

11.1. For any assistance on the Products, more information, suggestions, complaints, and/or any other requests, the Customer can contact the Seller's customer service at any time via email at: congierge.service@barberpisterzi.com

 

12. RECURRING ORDER (starting from March 2022)

 

12.1 For some Products, the Customer can activate the Recurring Order option, which allows the selected Products to be automatically ordered and delivered with the required frequency. 

 

12.2 The Recurring Order option can be activated only for some Products selected by the Seller and required by the relevant Product sheet. The option is only available for Customers who have created a personal account on the E-Site. 

 

12.3 To activate this option, the Customer must select the quantity and frequency with which he wishes to receive the Product in the Recurring Order section of the chosen Product sheet. If not already logged in, the Customer must access their account and complete the request by entering the shipping and payment data used for all periodic purchases of the selected Product. 

 

12.4 The request for the Customer's recurring Purchase option is considered accepted by the Seller with the sending, by the latter, of the email confirming the activation. 

 

12.5 Once the option has been activated, the selected Product will, from time to time and automatically be ordered and delivered to the Customer with the frequency methods chosen. 

 

12.6 Before the shipment of each Product, the Seller will send the Customer an email reminder with the details of the following Order, the expected date for its fulfillment, and the instructions to cancel the Order. This email is an automatic confirmation of the order programming and does not imply acceptance by the Seller of the Customer's purchase order. 

 

12.7 Each Order integrates a single purchase proposal for the Product and is considered accepted from time to time by the Seller by sending the email confirming the shipment of the Product. Each Order accepted by the Customer integrates a separate sales contract under the General Conditions of Sale. 

 

12.8 At the time of shipment, the Seller will proceed to charge the Customer the Product's price, including any applicable taxes and shipping costs, using the payment method indicated at the time of activation of the recurring Order. If it is not possible to charge the Customer with the selected payment method and the Customer does not arrange an alternative payment method, the Order will be canceled and the Recurring Purchase option disabled. 

 

12.9 The price and availability of the Products may vary over time. Each Order will apply the price list applied by the Seller for the Site when the Order is processed. The Customer can still cancel the Order before the shipment of the Products, following the instructions in the reminder email provided by art. 7.6 above or through the Customer's personal account on the E-Site. 

 

12.10 If the selected Product is out of stock or unavailable, the Order will be temporarily suspended, and the Seller will contact the Customer to update him on its status. 

 

12.11 The Customer can modify or deactivate the recurring purchase option in the "My orders" section of his personal account at any time, effective for orders after modification or deactivation. 

 

12.12 For each Order, the Customer can exercise the right of withdrawal according to art. 6 within 14 days from the day of acquisition of physical possession of the Products delivered from time to time. 

 

12.13 The Seller reserves the right at any time to modify the selection of Products available for the Recurring Order option and/or to cancel the option activated by the Customer.
